1. Agreeing to these terms

NFTFactory ("we", "the platform") lets you build generative NFT collections, deploy them to a blockchain from your own wallet, and sell them from a hosted mint page. By signing in and using the Studio you agree to these terms. If you don't agree, don't use the platform.

2. Your art and your rights

You must own, or have a license that lets you use and sell, every image, layer, name and piece of text you upload, generate or publish through NFTFactory. That includes images made with AI tools: you are responsible for following the terms of the AI provider you use.

You keep the rights to your art. You give NFTFactory a non-exclusive, worldwide, royalty-free license to store, process, display and publish it (including to IPFS) as needed to run the platform and promote your collection on it.

If someone claims your collection infringes their rights, we may delist it while we look into it. You agree to cover any costs and claims that arise from content you didn't have the rights to.

3. What isn't allowed

No hate speech: content that attacks or demeans people for their race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability or similar characteristics.

No harassment, threats, bullying or content targeting a real private person.

No sexual content involving minors, ever. No other sexually explicit content.

No content that infringes copyright or trademarks, impersonates others, or is illegal where you or your buyers are.

No scams: no misleading claims about a collection, its utility or its returns, and no fake or wash activity.

4. Delisting

We may delist any collection from NFTFactory, at our discretion and without notice, if we consider it to break these terms (including hate speech or harassment) or for any other reason. Delisting removes the collection from our site: its mint page, listings and any files we host for it.

Smart contracts live on a public blockchain that nobody controls. We cannot delete a deployed contract or take back tokens that were already minted, and delisting doesn't change them.

5. The blockchain side

You deploy your collection contract from your own wallet and you control it. Blockchain transactions are public and can't be reversed. You pay any network (gas) fees.

We never hold your funds or your keys. Never share your seed phrase or private keys with anyone, including us.

The protocol fee is 0% today. Any future fee would only apply to collections deployed after the change, and is copied into a collection at deployment.

6. No financial advice, no guarantees

Nothing on NFTFactory is financial or investment advice. NFTs can lose all their value.

The platform is provided "as is". We do our best to keep it working, but we don't guarantee it will be available, error-free or secure, and the smart contracts have not yet had an external audit. To the extent the law allows, we aren't liable for lost profits, lost tokens or indirect damages from using the platform.

7. Changes

We may update these terms. When we do, we'll change the date above and ask you to agree again before you keep using the Studio.
